Welcome to North Bloom! The North Bloom website is provided by North Bloom and/or its affiliates and subsidiaries (NB) for your personal, non-commercial enjoyment, subject to the terms and conditions of use set forth here and all modifications thereto (the “Terms”), and the rules that may be revised by North Bloom. By using this site, you are explicitly agreeing to these Terms. The term “site” includes webbed located at north-bloom.com and any other online properties owned or operated by us.

We may revise these terms at any time without actual notice. All such changes to the terms will appear on our site, and be effetely immediately. By using this site after we post any changes, you agree to accept those changes, weather or not you have reviewed them. If at any time you choose not to accept these terms, please do not use this site.

Description of Services

North Bloom, via the site, provides users the ability to purchase flower arrangements, plants and gift products and service (“Goods,” and “Services”) at a low, flat rate.

Privacy Policy

North Bloom (owners of north-bloom.com) takes very seriously the private nature of your personal information. This Privacy Policy describes how we treat the information we collect when you visit and order from our website. Please read this notice carefully.

User Consent

By accessing or using North Bloom, you agree to the terms and conditions of this Privacy Policy, which is a part of the North Bloom terms of service. You expressly consent to the processing of your Personal Information according to this Privacy Policy.

Personal Information

We collect your Personal Information voluntarily through North Bloom in order to create your user profile and account, as well as to fulfill your orders. The types of personally identifiable information that may be collected in order to fulfill order requests include: full legal name, billing and shipping addresses, e-mail address, telephone number, and credit card information.

In some instances, we may request that you submit information about other people. For example, if you order a gift arrangement to be sent directly to the recipient, we will ask for the recipient’s name, address, telephone number, and email address. 
Additional, we may collect any information that you voluntarily disclose, including Personal Information, and any posting, comments, forums, or blogs within the North Bloom community.

We will never sell, rent or share your personal information, including your e-mail address, with any third parties for marketing purposes without your express permission. We may share your personal information for the purpose of delivering our e-mail to you or as required by law. 

Personal Information from other sources
We may receive Personal Information about you from other sources with which you have registered, companies who have partnered with (collectively, “Partners”) or other third parties. We may associate this information with the other Personal Information we have collected about you. 

Non-Personal Information

We ma also request non-personally identifiable information, such as age, annual income, buying preferences, etc., also know as demographic data, though this information is optional. We may use this data to improve our site products, showing you content that we think you might be interested in, and displaying content according to your preferences. We may also share this information with others, such as advertisers interested in advertising in the email send out or our site, in aggregate, anonymous form, but will not contain any personally identifiable information about you or any other person. 

Information Collected Via Technology

As you use North Bloom, certain information may also be passively collected and stored on our service providers’ server logs, including your Internet protocol address, browser type, and operating system. We also use Cookies and navigational data like Uniform Resource Locators (URL) to gather information regarding the date and time of your visit and the solutions and information for which you searched and viewed, or on which of the advertisements you clicked. This type of information is collected to make North Bloom more useful to you and to tailor the experience with North Bloom to meet your special interests and needs. 

Tracking

An “Internet protocol address” or “IP Address” is a number that is automatically assigned to your computer when you use the Internet. In some cases your IP Address stays the same from browser session to browser session; but if you use a consumer Internet access provider, your IP Address probably varies from session to session. For example, we, or our service providers, may track your IP Address when you access North Bloom to assist with ad targeting.

“Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing a website. They allow us to quickly check your status as a subscriber and facilitate access to your preferences. We may use Cookies to provide you with more personal and interactive experience with North Bloom. We will never use cookies to retrieve information from a computer that is unrelated to our site or services.

We may also enable advertisers and ad servers to promote third-party products and/or services by placing advertisements on North Bloom. These advertisers and ad servers may use Cookies and/or “Web Beacons” (small transparent graphic images) in order to monitor information related to served advertisements. Clicking on such advertisements will direct you to the website of a third-party and the advertiser. This Privacy Policy does not cover the privacy practices of any advertisers or ad servers outside of North Bloom.

We welcome (an appreciate) feedback. If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the Personal Information in it in accordance with this Privacy Policy. You agree that any such comments and email communication we receive becomes property of North Bloom. We may use feedback for marketing purposes or to add to or modify our services without paying any royalties or other compensation to you.

We are committed to protecting the security of your Personal Information. We use industry-standard security technologies and procedures to help protect your information from unauthorized access, use, or disclosure. Even though we have attempted to take all possible precautions, we cannot fully eliminate security risks associated with Personal Information.

North Bloom may at our sole discretion edit this Privacy Policy. All such future modifications will be posted here.

Terms of Sale

By placing an order on north-bloom.com, you agree to pay the price applicable for the product or service (including any sales taxes, surcharges, or delivery fees), and agree to the terms, restriction, and conditions of the purchase as of the time you submitted the order. Unless you and North Bloom have agreed to an alternate billing arrangement in writing signed by North Bloom, we will automatically bill the credit card submitted as part of the order process for such price. After placing your order, you will receive a confirmation email and a confirmation email once your order is delivered. All purchases are non-refundable.
You are required to create and account in order to purchase from North Bloom. An account is required so we can collect information to allow you to pay for your products and provide you with easy access to print your receipts, view your past purchases, and modify your shipping and billing preferences.
With limiting other remedies, we reserve the right to charge a late fee on all past due payments equivalent to the lesser of one and a half (1.5%) per month on unpaid balance or the highest rate allowed by law. You will pay for all collection costs, attorneys fees, and court costs incurred in the collection of past due amounts.

Discounts

Discounted delivery is available for multiple arrangements being delivered on the same date to one location. Please email us for an exact quote.

Sales Tax

Sales taxes are not included in the price of the products. We will automatically chard and withhold the applicable sales tax for orders place through www.north-bloom.com.

Delivery

North Bloom products are personally delivered by our staff whenever possible via vehicle. We make every effort to deliver your order as quickly as possible. Limited same-day delivery is available, on a first-come, first-serve basis. To ensure next day delivery, orders must be received prior to 12:00 p.m. the day prior to your desired delivery date. Saturday and Sunday deliveries are only available upon special requests by contacting North Bloom to obtain approval.

Deliveries will be made between the hours of 9 a.m. and 5 p.m. PST. We cannot guarantee delivery time, but will do our best to accommodate your preferences.

Specific instructions must be provided at time of order, to ensure recipient, or authorized receiver, is available to receive the flowers at the time of delivery. Regretfully, we are only able to make one delivery attempt. If we are unable to locate the recipient, or authorized receiver, at the time of delivery, we may leave the flowers outside of the residence or with a nearby business or neighbor. If we do leave the flower at a different nearby location, we ill notify the recipient by phone or email.

Before major holidays ,we recommend that you place orders at least five days in advance.

Delivery outside of Butte County
At this time North Bloom can provide flower delivery service solely within Butte County limits. If you live outside Butte County, and would like to order multiple arrangements (for an event, business, or company collective purchase), please email us to inquire about availability for your desired date. We will try to accommodate as many requests as possible.

Delivery to Hospitals
When placing your order please be sure to include the hospital name and telephone number, the name of the recipient and room number or ward of the recipient.

We will send your arrangement in accordance with facility procedures, as most hospitals do not allow florist to personally deliver to individual rooms. Please note that many ICU patients are not permitted to receive flowers. Please check with hospital before placing your order.

Recipient Availability
Please leave very specific instructions for the delivery of your floral arrangement in the “Delivery Instructions” field during check out. We can only make one delivery attempt for each order. In all other cases, if the recipient is not available when the courier attempts to deliver, they will either:

Leave the arrangement with a neighbor or nearby business.
Leave the arrangement with a business employee if delivering to a business.
Leave the arrangement in a covered, secure area of the home (porch, garage, or other entrance).

Vase Substitution Policy

North Bloom attempts to use vases represented in the photos on our site, however in the event that we are unable to use these vases, we will substitute it with a vase of a similar size.

Payment Options

North Bloom accepts Discover, Mastercard, Visa & American Express. All orders are subject to CA sales tax. You will have an opportunity to review this amount before submitting your order.

Restriction on Use of Material

Only if you obtain prior written consent from North Bloom, and from all other entities with an interest in the relevant intellectual property - may you publish, display, or commercially exploit any material from the site. To see our permission, you may write us at mail@north-bloom.com. If permission is granted by us and by all other entities with an interest in the relevant intellectual property, you may not change or delete any author attribution, trademark, legend, or copyright notice. You must abide by all additional copyright notices or other restrictions contained on the site. 

Links to Third Party Sites

We do not have control over websites that North Bloom may link to. Our website may contain links to third party websites that are not owned, operated, or controlled by North Bloom. Therefore, we cannot and do not assume responsibility for the content, privacy policies, or practices of such websites or the companies that own them. Additionally, we cannot and will not censor or edit the content of any third party site. By using North Bloom, you expressly relieve us from any and all liability arising from your use of any third party website. 

Disclaimers of Warranty

We provide the site and services “as in”, “with all faults” and “as available.” We and our supplies are partners make no express warranties or guarantees about the site, goods or services. The extent permitted by law, we and our Officers, Directors, Agents, Partners, and Vendors disclaim implied warranties that the site and services are merchantable, of satisfactory quality, accurately depicted and described, appropriate for a particular purpose or need, and non-infringing. We do not guarantee that North Bloom will meet your particular purpose or need, is error-freed, reliable and available at all times, and without interruption. We do not make any warranties as to privacy and security other than as expressly stated in the Privacy Policy. No oral or written information or advice given by a North Bloom representative shall create a warranty. You may have additional consumer rights under your local laws that this contract cannot, and does not attempt to, change. 

Limitations of Liability

Your sole remedy for any dispute with us is to discontinue your use of North Bloom. In no event shall our liability, or the liability of our Officers, Director,s Agents, Partners, and Vendors, for any and all claims relating to the use of the site and service, exceed the total amount of fees that you paid during the previous one-year period of use for the specific service of the issue. We, our Officers, Directors, Agents, Partners, and Vendors, shall not be liable for any indirect, incidental, consequential, or special damages arising from your use, or inability to use, or reliance upon our site and services. These exclusions apply to any and all claims of lost profit or goodwill, even if we knew, or should have known, of the possibility of damages. If jurisdiction does not allow the exclusion of liability for damages, in such jurisdiction, our liability, and the liability of our Officers, Directors, Agents, Partners, and Vendors, shall be limited to the extent permitted by law.
